What Is Breed Correction?

Property Type Correction (change of property type), is the process of changing the property information recorded in the land registry of a real estate (land, plot, field, etc.) to reflect its actual and real situation.

For example; if a legal building is constructed on a real estate registered as "land" in the title deed, the property type of the real estate should be updated from land to "building" or "residence". This official change in the title deed record is called property type correction.

What is Property Type?

The types of real estates in the land registry are referred to as "property type". The main types of real estates are:

  • Land

  • Field

  • Building

  • Residence

  • Shop / Workplace

  • Factory

Why is Property Type Correction Made?

  • To make the official situation of the real estate in the title deed completely compatible with its actual use,

  • To register a building with a building completion certificate (habitation certificate) as a building or residence in the title deed,

  • To prevent inconsistencies between documents in official transactions such as purchase and sale, mortgage, inheritance, and establishment of condominium ownership,

  • To ensure the correct calculation of property tax and related legal obligations.

How is Property Type Correction Made?

The property type correction process is carried out in the following steps:

  1. A building permit and a building completion certificate (habitation certificate) are obtained from the relevant municipality.

  2. The necessary projects and sketches are prepared by an authorized surveyor or relevant technical personnel.

  3. An application for property type correction is made to the Land Registry Office.

  4. After the application file is reviewed, the "property type" information of the real estate in the land registry is updated.

Required Documents

  • Building permit

  • Building completion certificate (Habitation certificate)

  • Architectural project and building sketch

  • Application petition

  • Owner's identity photocopy and title deed

  • Technical documents requested from the cadastre directorate, if necessary

What Happens if Property Type Correction is Not Made?

  • The building on the real estate is not officially recognized.

  • Critical real estate transactions such as sale, mortgage, inheritance sharing, or establishment of condominium ownership may be disrupted.

  • Since the information in the title deed does not reflect the reality, it may cause legal disputes in the future.

  • Incompatibilities may occur in property tax declarations and valuations, and a penalty risk may arise.

Conclusion

Property type correction is a vital step to equalize the actual use of a real estate with the accuracy of its title deed records. Having this process done after the construction is completed eliminates all legal and financial risks in the future. Especially in properties with a habitation certificate, it is recommended that the property type correction process be completed without delay.
